Overlapping Tenement Management
We help clients from the resources sector holding coal mining, petroleum and greenhouse gas storage tenements (exploration, production, and pipelines) manage overlapping tenement processes under the Queensland Government’s Mineral and Energy Resources (Common Provisions) Act 2014 (MERCPA), Coal Mining Safety and Health Act 1999, Petroleum and Gas (Production and Safety) Act 2004, and associated Regulations, including:
• negotiation of amendments to existing Co-Development Agreements and Coordination Arrangements executed under the pre-MERCPA regime

Land Access and Land Use

For locations in Queensland, we consider the various requirements under the Queensland Government’s Planning Act 2016, Mineral and Energy Resources (Common Provisions) Act 2014 (MERCPA), Environmental Protection Act 1994, Aboriginal Cultural Heritage Act 2003, Regional Planning Interests Act 2014, Water Act 2000, as well as various vegetation, nature, biodiversity and biosecurity Acts and Regulations, local planning scheme requirements, and other interrelated Acts, Regulations and guidelines to:
• negotiate Conduct and Compensation Agreements (CCAs) for landowners, occupiers and resource tenement holders
• negotiate Infrastructure Agreements with government agencies
• prepare notifications for road use and access to state lands and easements
• negotiate royalty agreements for quarry products (stone, rock, gravel) and other materials
